Terms of service

These terms govern the use of ticketsPlease (the «app»), provided by Agencia de Medios Forrate SpA, Chile («Forrate», «we»), to the store that installs it (the «store», «you»). By installing the app you accept these terms and our Privacy policy.

1. The service

The app lets a Shopify store sell dated tickets with daily capacity, collect visitor details, issue a QR code per person and record check-in and check-out at the venue. Payment is processed by Shopify's checkout; Forrate never handles the store's customers' payments.

2. Plans and billing

Plans, prices and usage charges are those shown in the Shopify App Store listing and in the app when you choose a plan. They are billed by Shopify on your Shopify invoice. You can change or cancel your plan at any time; charges already billed are not refunded except where Shopify's policies or the law require it. We will give at least 30 days' notice before raising the price of a plan you are on.

3. Your responsibilities

• Set capacity, dates and prices correctly and honor the tickets you sell.
• Collect only the visitor details you need, tell your customers how you use them (in your own privacy policy) and obtain any consent the law requires, especially for health data.
• Comply with the laws that apply to your business, events and venue.
• Keep staff PINs private and deactivate staff who no longer need access.
• Not use the app for unlawful events or to send unsolicited messages.

4. Availability and support

We work to keep the app available and fix problems quickly, but we do not guarantee uninterrupted service. The check-in screen keeps working through short signal drops and syncs when the connection returns. Support is by email at hola@forrate.cl, in English and Spanish.

5. Data processing terms

For the personal data of your customers that the app processes, you are the controller and Forrate is your processor. Forrate will:

1. Process that data only to provide the app and on your documented instructions, which are these terms and the settings you choose in the app.
2. Ensure that people authorized to access it are bound by confidentiality.
3. Keep appropriate security measures: encryption in transit and at rest, hashed staff PINs, access limited to personnel who need it, separate test and production data, and backups with point-in-time recovery.
4. Use only the sub-processors listed in the Privacy policy, and notify you before adding or replacing one.
5. Help you answer your customers' requests to access, correct or delete their data, including the requests Shopify sends us.
6. Notify you without undue delay, and within 72 hours, after becoming aware of a personal data breach affecting your data.
7. Delete your data when the retention period you set ends, and all of your store's data when Shopify asks us to after you uninstall the app.
8. Give you the information reasonably needed to show compliance with these obligations.

6. Intellectual property

The app, its design and its code belong to Forrate. You keep all rights to your store's content and data. You give us permission to use them only to provide the app.

7. Limitation of liability

To the extent permitted by law, Forrate is not liable for indirect or consequential losses, lost profits or lost revenue, and our total liability for any claim related to the app is limited to the amounts you paid us for the app in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law.

8. Ending the service

You can stop using the app at any time by uninstalling it. We may suspend or end the service if you seriously breach these terms, after notice where possible. Sections 5, 6 and 7 survive the end of the service.

9. Changes and law

We may update these terms and will post the new version here with its date; significant changes will be notified in the app or by email. These terms are governed by the laws of Chile, and the courts of Santiago have jurisdiction, without prejudice to mandatory consumer or data protection rules that apply to you.

Estos términos regulan el uso de ticketsPlease (la «app»), que presta Agencia de Medios Forrate SpA, Chile («Forrate», «nosotros»), a la tienda que la instala (la «tienda», «tú»). Al instalar la app aceptas estos términos y nuestra Política de privacidad.

1. El servicio

La app permite a una tienda Shopify vender entradas con fecha y cupo diario, pedir datos a los visitantes, emitir un QR por persona y registrar ingresos y salidas en el lugar. El pago lo procesa el checkout de Shopify; Forrate nunca maneja los pagos de los clientes de la tienda.

2. Planes y cobro

Los planes, precios y cobros por uso son los que muestran la ficha de la Shopify App Store y la app al elegir un plan. Los cobra Shopify en tu factura de Shopify. Puedes cambiar o cancelar tu plan cuando quieras; lo ya cobrado no se reembolsa, salvo que las políticas de Shopify o la ley lo exijan. Avisaremos con al menos 30 días antes de subir el precio de un plan que estés usando.

3. Tus responsabilidades

• Configurar bien cupos, fechas y precios, y respetar las entradas que vendas.
• Pedir solo los datos de visitantes que necesites, informar a tus clientes cómo los usas (en tu propia política de privacidad) y obtener los consentimientos que exija la ley, en especial para datos de salud.
• Cumplir las leyes que se aplican a tu negocio, tus eventos y tu lugar.
• Mantener en reserva los PIN del personal y desactivar a quien ya no necesite acceso.
• No usar la app para eventos ilícitos ni para enviar mensajes no solicitados.

4. Disponibilidad y soporte

Trabajamos para que la app esté disponible y para corregir problemas rápido, pero no garantizamos un servicio sin interrupciones. La pantalla de la puerta sigue funcionando con cortes breves de señal y se sincroniza al volver la conexión. El soporte es por correo a hola@forrate.cl, en inglés y español.

5. Condiciones de tratamiento de datos

Para los datos personales de tus clientes que trata la app, tú eres el responsable y Forrate es tu encargado. Forrate:

1. Tratará esos datos solo para prestar la app y según tus instrucciones documentadas, que son estos términos y los ajustes que elijas en la app.
2. Asegurará que las personas autorizadas a acceder a ellos estén obligadas a confidencialidad.
3. Mantendrá medidas de seguridad adecuadas: cifrado en tránsito y en reposo, PIN del personal cifrados de forma irreversible, acceso limitado a quien lo necesite, datos de prueba separados de los de producción y copias de seguridad con restauración a un punto en el tiempo.
4. Usará solo los subencargados indicados en la Política de privacidad y te avisará antes de agregar o reemplazar uno.
5. Te ayudará a responder las solicitudes de tus clientes para acceder, corregir o borrar sus datos, incluidas las que nos envía Shopify.
6. Te avisará sin demora indebida, y dentro de 72 horas, al conocer una vulneración de seguridad que afecte tus datos.
7. Borrará tus datos al terminar el plazo de conservación que fijes, y todos los datos de tu tienda cuando Shopify lo pida después de desinstalar la app.
8. Te dará la información razonablemente necesaria para demostrar el cumplimiento de estas obligaciones.

6. Propiedad intelectual

La app, su diseño y su código pertenecen a Forrate. Tú conservas todos los derechos sobre el contenido y los datos de tu tienda, y nos autorizas a usarlos solo para prestar la app.

7. Limitación de responsabilidad

En la medida que la ley lo permita, Forrate no responde por daños indirectos, lucro cesante ni pérdida de ingresos, y nuestra responsabilidad total por cualquier reclamo relacionado con la app se limita a lo que nos pagaste por la app en los 12 meses anteriores al reclamo. Nada en estos términos limita una responsabilidad que la ley no permita limitar.

8. Término del servicio

Puedes dejar de usar la app cuando quieras desinstalándola. Podemos suspender o terminar el servicio si incumples gravemente estos términos, avisándote antes cuando sea posible. Las secciones 5, 6 y 7 siguen vigentes después del término.

9. Cambios y ley aplicable

Podemos actualizar estos términos y publicaremos aquí la versión nueva con su fecha; los cambios importantes se avisarán en la app o por correo. Estos términos se rigen por las leyes de Chile y son competentes los tribunales de Santiago, sin perjuicio de las normas obligatorias de consumo o de protección de datos que te apliquen.
